March 2023 Visa Bulletin Brings Retrogression

Washington, DC, February 15, 2023: The US Department of State released the March Visa Bulletin today. All employment based preference categories for Indian born applicants retrogressed. The EB-1 classification retrogressed to February 1, 2022 for both India and China.

Interestingly, EB-5 immigrant investor “reserved” categories remain Current and available. Reserved EB-5 visas are reserved for investments in projects located in rural areas, urban high unemployment areas and infrastructure projects.

Since these reserved categories are Current, an applicant who is lawfully in the U.S. may be eligible to concurrently file the EB-5 visa petition on Form I-526 and simultaneously file I-485 Adjustment of Status (with I-765 EAD and I-131 Advance Parole).
