Washington D.C., Dec. 19, 2019: The House of Representatives and the Senate have approved legislation that extends the EB-5 Regional Center Program until September 30, 2020.
The extension of the EB-5 Regional Center Program does not include changes to the program’s requirements. The USCIS regulations that entered into effect on November 21, 2019, therefore remain unchanged.
The new EB-5 regulations increased minimum investments to $900,000 for high-unemployment areas and rural areas and $1.8 million in other areas.
USCIS has not yet issued rules, forms, or procedures for requesting a designation of a high-unemployment area. Thus, no high-unemployment areas are currently certified by USCIS. Areas that formerly qualified as targeted employment areas before the regulations changed are no longer in effect.
