March 2023 Visa Bulletin Brings Retrogression

Washington, DC, February 15, 2023: The US Department of State released the March Visa Bulletin today. All employment-based preference categories for Indian-born applicants retrogressed. The EB-1 classification retrogressed to February 1, 2022, for both India and China.

Interestingly, EB-5 immigrant investor “reserved” categories remain current and available. Reserved EB-5 visas are reserved for investments in projects located in rural areas, urban high-unemployment areas, and infrastructure projects.

Concurrent Filing Benefits for EB-5 Applicants

Since these reserved categories are current, an applicant who is lawfully in the U.S. may be eligible to concurrently file the EB-5 visa petition on Form I-526 and simultaneously file I-485 Adjustment of Status (with I-765 EAD and I-131 Advance Parole).
