PRIVACY POLICY

Your privacy is important to us. This Privacy Policy sets forth the privacy practices of the website located at visaeb-5.com (the “Site”) which is owned and operated by U.S. Immigration Fund, LLC and its affiliates (“USIF”). Specifically, it outlines the types of information that USIF gathers about you, and the ways in which USIF respects, protects and uses this information. This Privacy Policy does not apply to any information you may provide to USIF, or that USIF may collect, offline and/or through other means.

Please read this Privacy Policy carefully. By accessing the Site and providing us with information, you are consenting to USIF’s collection and use of your information in accordance with this Privacy Policy. While USIF strives to protect the privacy of its Site users, this Privacy Policy does not create or confer upon any individual any rights or impose upon USIF any obligations.

NON-PERSONALLY IDENTIFIABLE INFORMATION

We and/or third parties authorized by USIF may collect and store non-personally identifiable information about you which is generated automatically through your use of the Site. Non-personally identifiable information, by itself, cannot be used to identify you (e.g., demographic and profile data). Non-personally identifiable information includes, without limitation, your: (i) IP address (a number that is assigned to your computer when surfing the web), (ii) MAC address (a number that is assigned to your network card by the manufacturer); (iii) browser type; (iv) operating system; and (v) UID (a user identification number).

Non-personally identifiable information also includes cookies. “Cookies” are small files containing a string of characters that are sent to your computer when you visit the Site. They are stored on your computer by your browser. When you visit the Site again, the cookies allow the Site to recognize your browser. Cookies are used, among other things, to authenticate your authority to access the Site, and store your user preferences (e.g., language) and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, the Site may not function properly without cookies.

USIF does not link any non-personally identifiable information to personally-identifiable information (described below).

USIF may use this information to create “aggregate data” reports to, among other things, measure (a) the number of visits; (b) the average time spent on the Site; and (c) pages viewed. Such information may be disclosed to third parties in order to prepare these reports. This information will allow us to improve the Site’s content according to our users’ needs.

PERSONALLY IDENTIFIABLE INFORMATION

USIF only obtains your personally identifiable information through the Site if you voluntarily provide it (via submissions/registration forms). Personally identifiable information includes, without limitation, your full name, phone number, email address, country of residence, and country of citizenship.

Unless you opt-out (as described in greater detail below), USIF may use your personally identifiable information as follows: (i) to contact you in conjunction with your registration or information requests; (ii) to provide you with information about USIF or any of its projects; or (iii) to provide you with a more effective customer experience (e.g., to deliver account information and provide notification services).

USIF may enlist the services of a third party to perform certain functions on our behalf (e.g., creating and maintaining the Site, sending postal mail and e-mail, analyzing data, and providing other marketing and customer assistance). While third parties would have access to your personally identifiable information, such access will be exclusively for the purpose of performing these functions, and for no other purpose. Moreover, when possible, USIF obtains contractual obligations from these third parties to ensure safeguards for the privacy and security of the information which are at least as restrictive as this Privacy Policy.

Notwithstanding anything to the contrary, USIF may disclose personally identifiable information (i) if required to do so by law, court order, subpoena or other legal process, (ii) as requested by a governmental or law enforcement authority, (iii) to enforce or apply applicable terms of use or other agreements, (iv) protect the rights, property, or safety of USIF or our users; or (v) when we believe in good faith that disclosure is necessary or advisable (this includes exchanging information with other companies and organizations as part of our efforts to prevent fraud and identity theft).

PROTECTION OF PERSONALLY IDENTIFIABLE INFORMATION

USIF maintains strict physical, electronic and procedural safeguards to protect your personally identifiable information and regularly reviews its security standards and procedures to protect against unauthorized access. Although USIF takes reasonable steps to safeguard and to prevent unauthorized access to your personally identifiable information, it cannot be responsible for the acts of those who gain unauthorized access, and USIF makes no warranty, express, implied, or otherwise, that we will prevent unauthorized access to your personally identifiable information.

OPTING OUT

If you do not want USIF to use (e.g., for sending you emails) or share your personally identifiable information, please send an email referencing “Opt Out” on the subject line and in the body of the message to [email protected]. Please also include your full name, your current address and previous address if you have been at your current address fewer than six months and your email address. USIF will process your request but it may not immediately update in our system; you may still receive communications from us in the interim. Regardless of your opt-out request, we reserve the right to send you emails or other electronic messages for administrative purposes. To re-subscribe, you may resubmit your information on the Site.

OTHER SITES

This Privacy Policy covers only the Site and does not cover any other site, including those that may be related or linked to this Site (e.g., www.wechat.com and www.usifund.concertocloud.com). While we make every effort to protect your information on the Site, we do not control the policies of other sites (including those we may link to). We have no control over other sites’ privacy policies or use of any personally identifiable information you or others may share with them. Please do not assume that our Privacy Policy covers those other sites.

CHILDREN

USIF does not knowingly collect personally identifiable information online from children under the age of 13 other than when necessary to comply with federal or state regulations, or for safety and security reasons. If you learn that your child has provided us with personal information online without your knowledge, you may contact us by sending an email to [email protected] and ask us to delete this information from our records.

No information we collect from children known to be under the age of 13 is used for any marketing or promotional purposes whatsoever, by either us, our affiliates, or our third party sponsors.

ACCURACY OF INFORMATION

When submitting information through the Site you agree to provide accurate, complete and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate or incomplete, we may prohibit you from further participation through the Site, and to pursue any appropriate legal remedies. However, you are entitled to request the correction of all personal data you provide to USIF.

STORING DATA

USIF will transfer, store, and process information that we collect about you, as described in this Privacy Policy, in the United States, which may not provide the same level of protection for your information as your home country. In addition, we may further transfer your information outside the United States for the purposes described in this Policy. By submitting any information or by using the Site, you consent to such transfer to, and processing in, the United States and these other countries, and acknowledge that your information may be subject to access by law enforcement and other government entities, including courts and tribunals, in accordance with laws applicable in those jurisdictions.

WAIVER OF DAMAGES

Under no circumstances shall USIF be liable for any direct, indirect, special, consequential or exemplary damages, including, but not limited to, claims of third parties, or any other damages whatsoever, howsoever arising (e.g., negligence or tort action), in connection with the use of the Site.

LEGAL EFFECT AND CHANGES TO THE POLICY

As indicated, this Privacy Policy is not a contract nor does it otherwise create any legal rights or obligations. Rather, this Privacy Policy merely reflects guidelines setting forth USIF’s intended business practices. However, by using the Site, and/or by providing personally identifiable information to USIF online, you consent to the collection and use of such information by USIF and third parties (so long as such use is consistent with this Privacy Policy and applicable law). Also, USIF, in its discretion, may amend, interpret, modify, or withdraw any portion of this Privacy Policy and related business practices at any time by posting updated text on this site, and your continued use constitutes your consent to those changes. SPECIAL NOTIFICATION FOR CALIFORNIA RESIDENTS

Users who are residents of California and have provided their personally identifiable information to us may request information regarding our disclosures, if any, of their personally identifiable information to third parties for direct marketing purposes. Such requests must be submitted to us at [email protected].

California privacy rights requests must include the reference “Request for California Privacy Information” on the subject line and in the body of the message and must include the email address or mailing address, as applicable, for us to send our response. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted other than to the email address specified above.
